They are the same organization that has petitioned the NHTSA & filed lawsuits to protect car owners over exploding gas tanks & other major safety issues. The contact owns a 2004 Mitsubishi Endeavor. While driving approximately 35 mph, the vehicle independently accelerated to 85 mph without warning. The brake pedal was depressed, but failed to respond. The contact shifted the vehicle into the neutral position and it stopped abruptly. As a result of the stop, the vehicle went into an embankment, flipped down a hill, and landed in another embankment. As the vehicle flipped, the dash panel detached and struck the contact. The air bags did not deploy. A police report was not filed and there were no injuries reported. The vehicle was driven to the contact's residence. The manufacturer was made aware of the failure. The failure mileage and VIN were unavailable.

In addition, the front seat passenger sustained a head injury that required surgery and back injuries that required medical attention. A police report was filed. The vehicle was destroyed. The manufacturer was notified of the failure. The failure mileage was 105,000.
