The contact owns a 2004 Mitsubishi Endeavor. While driving approximately 35 mph, the vehicle independently accelerated to 85 mph without warning. The brake pedal was depressed, but failed to respond. The contact shifted the vehicle into the neutral position and it stopped abruptly. As a result of the stop, the vehicle went into an embankment, flipped down a hill, and landed in another embankment. As the vehicle flipped, the dash panel detached and struck the contact. The air bags did not deploy. A police report was not filed and there were no injuries reported. The vehicle was driven to the contact's residence. The manufacturer was made aware of the failure. The failure mileage and VIN were unavailable.

When switching from neutral into drive the vehicle accelerated at 80 mph. Even when applying the brakes, the vehicle continued to surge. When the vehicle was placed in drive, the accelerator stuck and the vehicle lurched forward, exited the car wash, crossed a highway, hit a curb, grazed a telephone pole, proceeded into the jiffy lube into a grassy area and went back onto the highway, and turned 180 degrees and finally the vehicle turned into a 180 degree angle. The only way the vehicle was able to be stopped was by turning off the ignition.
