It started consistently popping out of 5th gear one day (about 50,000 miles) and it was fixed under warranty.

It did it again at 81,350 miles and I was quoted C$4500 (US$4000) for a new tranny or C$3200 (US$2900) for a used one, installed. Decided to go with third option--rebuild existing tranny--because we have a good transmission shop here in Victoria BC, and because that would result in a KNOWN GOOD transmission for less than new. But it still cost me C$3500 (US$3170).

I love this vehicle otherwise, or I might have dumped it right there.

I asked the transmission mechanic, and he considers the cause to be "a design flaw" ... he sees it often in Toyota Corolla/Matrix (who share this transmission).

Any chance Toyota would consider this a design flaw and give me any compensation?
