The contact owns a 2014 BMW 328D. The contact received notification of NHTSA Campaign Number: 18V755000 (Engine and Engine Cooling). The contact stated that while driving 60 MPH, the vehicle inadvertently decelerated to 40 MPH. The check engine warning light was illuminated. The EGR cooling message was displayed in the information center. The vehicle was taken to an independent mechanic where she was informed about fault code 29EB-00. The vehicle was taken to the local dealer however, the mechanic was unable to duplicate the failure. The vehicle was not diagnosed or repaired. The manufacturer was not contacted. The failure mileage was approximately 89,000.

While driving 70mph car went into neutral coasting to a stop. I had no control of the gas causing a dangerous sittuation as we coasted to the side of the road. After placing the vehicle into park, it would not start and needed to be towed. Vehicle could not be put into neutral for towing purposes. Repair shop said the timing chain had went out seizing and ruining the engine. 15K repair bill, very dangerous sittuation having no control over a vehicle at high speed highway driving!

While pulling slowly into a parking lane in a residential pulbic lot to park, the vehicle entered into a sudden high acceleration without any driver additonal input. It crashed on a tree at the parking lot perimeter with a major damage on the vehicle front end. It occurred at 10:30 am with driver in great health condition and had very limited time to react. No airbag was deployed nor any personal injury occured.

While driving at 65 mph or so the vehicle's on-board message center read "drive-train malfunction". I pressed on the accelerator and there was no response. The vehicle was loosing momentum quite quickly which required me to swiftly, but safely to pull over to the roadway edge. This is the third time the issue has presented itself. The first time was a few months from purchasing the vehicle. The dealer found metal shavings in the fuel lines. They replaced the entire fuel system and sent me off. A few months later I took the vehicle in for service I.e. oil change, inspection, etc. While inspecting my car they again found metal shavings in the fuel lines. They again replaced the entire fuel system and said it was fixed. Just this weekend September 30, 2018, I was driving my vehicle on the freeway and again the car went limp. No power, limited steering control, no response from accelerator. Essentially a catastrophic event because without power a vehicle is a rolling projectile. According to the dealership the vehicle once again has metal shavings in the fuel system. Total count for replacing fuel system (3).

Pursuant to the national traffic and motor vehicle Safety Act and this administrative Agency duty, I am submitting a complaint against BMW auto maker. We own a 2014 BMW 328I xdrive GT in which my wife, (safe driver), had an accident on 06/26/2018 due to "sudden unintended acceleration" while parking, leaving two (2) family members in the hospital with serious back injuries. While she was parking and at full stop with the brake pedal pressed, the vehicle sudden forcefully accelerated and took off jumping over a 12 inch parking lot barrier wall landing 4 feet down on a four (4) lanes busy road, waters avenue (tampa, fl). The vehicle was taken to the local BMW (reeves, tampa, fl) dealer were we purchased the car brand new and have been servicing the car. The BMW after charging $190, claimed to be unable to diagnose and duplicate the problem and will not acknowledge or admit having these type of problems this BMW 328I series contrary to this Agency claims and other disclosed in public media. The dealer did not even change the acceleration sensor for safety uncertain. Furthermore, be aware, this is the second time we experience this vehicle "sudden unintended acceleration" malfunction as in 2016 did it and the vehicle crashed while parking, still in slow motion, onto a handicap sign and a parking lot landscape island (in front if a best buy store). Likewise, at that time the dealer (revees) claimed to be unable to duplicate the problem and the vehicle's electronic check did not showed anomalies. We have pictures, police report, ambulance reports of latest incident and a business recorded the incident on a site security camera, so evidences available upon request. It is a sad day for us to experience BMW not doing anything to respond to our claim and/or at least prevent further safety human and property injuries resulting in tragedies.

This vehicle has experienced two incidents of unintended acceleration. On January 15, 2018 it occurred at freeway speeds (55 mph) and the vehicle accelerated to approximately 95 mph. Forcible application of the brakes slowed the vehicle and the acceleration reverted to normal. The second incident was on January 17, 2018. This occurred on a surface street at approximately 40 mph. The vehicle accelerated again to at least 90 mph, and upon application of brakes, reverted to normal operation. The vehicle has approx 40,000 miles on it. I took this car to kuni BMW in beaverton, Oregon. They checked out the car and reported that they could not duplicate the problem.

The contact leased a 2014 BMW 328I. While driving 55 mph, the accelerator pedal was depressed and failed to respond. The vehicle was towed to the dealer where it was diagnosed that the software in the vehicle needed to be updated. The contact was also informed that there was a diagnostic code for the drive train malfunction. The software was updated. The manufacturer was not notified of the failure. The approximate failure mileage was 27,564. Updated 05/31/17

Vehicle has on 4 separate occurrences stalled/failed to accelerate. "drivetrain malfunction" error code is displayed. The vehicle had 11564 miles on the odometer at the first occurrence. The faults were cleared, but because they could not replicate the failure, no action was taken. The second occurrence, 6 months and 9000 miles later, a sensor was replaced, faults cleared, no further action taken. The third time, six weeks later, a fuel quantity control valve was replaced. The car has just been towed for a fourth time. On 3 of the 4 occurrences, the car was on a highway or busy street, at one time traveling in excess of 60 mph. The last time was turning onto a busy highway, narrowly avoiding an accident. The first time was on a downtown city block, stalling in an intersection at low speed.

I pulled slowly into a parking space at the gas station. I stopped and I had my foot on the brake. I was pressing the park button when the car surged forward, accelerated over the curb and into the outside wall of the store. The damage to the car was enough to render it undriveable and there was significant damage to the building. Thank goodness, no one was on the sidewalk. Police and fire departments responded.

Driving on the highway, the car reported an error "chassis: Drive moderately. Consult service center." There were no other symptoms. I drove straight to the service center. The problem was not reproducible at the service center after turning the car off. After a couple of days in the service center the acceleration sensor was replaced. The day I received the car, I got the same error, this time while driving at around 20 mph. On stopping and restarting, the error was not reproducible. 500 or so miles later, I got the error once again, this time at around 40 mph. And again, on shutting the car off and restarting the error was not reproducible. I plan to contact the service center again tomorrow.
